What Is A CCA?

A “CCA” or Consumer Credit Agreement is a agreement regulated under Consumer Credit Act 1974.

We are looking particularly at the “CCA” funding schemes used by solicitors to progress claims.


How Could I have Been Missold?

Many people have found that they haven’t fully been made aware what they were signing or the implications of signing up for the CCA funding route. 

Some of the ways we are finding people have been mis-led are:

Failure to properly explain the pre-contract information.

Failing to explain the risks – on the face of it, the process of taking a CCA to fund your claim seems very efficient however people weren’t aware of the risks, such as if a claim fails you may be liable to pay back the money borrowed against your claim. 

A number of Consumer Credit Agreements used to fund legal disburstments and insurances we have seen were unenforcable. 


Why Is It A Risk?

People are now finding that their claims have failed or are no longer progressing as smoothly as was expected resulting in the funding providers pressuring the solicitors into getting some of the money back. 

It has started to happen whereby the solicitors/funders are now contacting the clients with claims that no longer meet the “criteria” to recover the money they never actually received!

Some Of The Claims That Could Be Affected

The CCA funding scheme was used for a number of different claim types, some of the more common ones are below

PCP

Against the dealerships for hidden commissions within their PCP agreements.

Housing Disrepair

Where the council Failed to repair damages within the homes of their tenants

Cavity Wall

Incorrectly installed cavity wall insulation resulting in damage and damp within the home

Knotweed

Where knotweed has grown within your property as a result of failure to properly remove it

Mortgage

Hidden commission and charges within your mortgage agreement from your broker or lender

Solar Panel

When solar panels have been installed with the understand that they would pay for themselves
